PAYMENT By presenting us with a payment card, you represent and warrant that you are authorized to use this payment card and that you authorize Shopify payments, our third-party payment processor, to charge the total amount of your order (including all applicable taxes and other charges) charged to your payment card. If the payment information you provided is declined or we are otherwise unable to process your transaction, your order may be cancelled, suspended or delayed. It is your responsibility to solve the payment problems that AKSA Home encounters when processing your order. 2. AVAILABILITY AND PRICES All products offered on the AKSA Home site are subject to availability. We reserve the right to impose quantity restrictions on an order, change an order in whole or in part, or discontinue offering certain products without notice. Prices for our products are subject to change at any time, but changes will not affect any order(s) already placed.

3. SHIPPING The prices of the products we offer for sale in our webshop do not include shipping costs. Our shipping charges and methods are as set out on our website from time to time. Title to products purchased from our online store passes to the customer when AKSA Home hands them over to the carrier, but AKSA Home and/or the carrier are responsible for any loss or damage that occurs while the product is on its way to you. is. All safety warnings, information, instructions, packaging, box materials, mobile apps and support services are provided in all European languages. 4. RETURNS AND REFUNDS If you want to return or exchange something you bought from us, that's no problem at all. You have 14 days from the day of delivery to ensure that what you have purchased from AKSA Home suits you. If you are not 100% satisfied with your purchase, you can return your order for a refund. Any product you return must be returned complete with all parts and with all original packaging and accessories, including the box, instructions/manuals and all other items that originally came with the product. It is your own responsibility to deliver your product to the selected Pickup Parcelshop for return within the return period of 14 days and to keep the receipt. Pack it carefully, as we do. AKSA Home reserves the right, at its sole discretion, to determine whether a returned product is in new condition. We reserve the right to impose a penalty if the returned product is received outside the return period and/or in a non-saleable condition.

5. LIMITED WARRANTY AKSA Home warrants all products sold by AKSA Home to be free from defects in materials and workmanship for a period of two (2) years from the date of delivery, unless otherwise specified with the product. In the case of repairs and replacements under warranty, the original warranty period or a warranty of six (6) months from the date of the repair or replacement, whichever is longer, shall apply. If AKSA Home believes that a product is defective, then AKSA Home 's sole responsibility is to repair or replace, at its option, the defective product. AKSA Home is not responsible for any costs, losses or damages arising out of the loss or use of its products and AKSA Home specifically disclaims all claims for consequential and incidental damages

This limited warranty is subject to several important restrictions: · This limited warranty only applies to products purchased directly from AKSA Home . • This limited warranty extends only to the original purchaser of a product and is not transferable to anyone else by sale, rental or transfer of the product. · The standard warranty period starts on the day of delivery and requires proof of purchase, whether or not you have registered your product for warranty. • A replacement part or product can only be provided in the country of purchase. · This limited warranty does not cover normal wear and tear. · This limited warranty does not apply to anything other than defects in the production and manufacture of the product. · The limited warranty is voided in the event of: (i) Any modification or repair in any way made by anyone outside of AKSA Home approved services or products. (ii) Damage caused by misuse, improper maintenance, use other than as described in the instructions, use other than what can be expected as fair use, malicious acts, negligence, accidents, natural disasters or physical violence. (iii) An attempt to combine the product with a third party product and/or accessories. (iv) Loss of parts. · To get service within the warranty, first contact AKSA Home to determine the problem and the most suitable solution for you. Your use of our products is at your own discretion and risk. You are solely responsible for (and AKSA Home disclaims responsibility for) any loss, liability or damage resulting from your use of our products, including death or personal injury.

ALL WARRANTIES IMPLIED BY COUNTRY LAW, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY LIMITED TO THE DURATION OF THE LIMITED WARRANTY. TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS, IN NO EVENT (A) SHALL AKSA HOME BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, SPECIAL OR INCIDENTAL DAMAGES, INCLUDING DAMAGES FOR LOST DATA OR LOST PROFITS, ARISING FROM IN OR IN RESPECT OF THE PRODUCTS, EVEN IF EASYWALKER KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES, AND (B) EASYWALKER'S TOTAL CUMULATIVE LIABILITY WILL BE EXECUTED FLUENTLY OR WITH RESPECT TO THE PRODUCTS, IN CONTRACT, LIABILITY LAW, OR OTHERWISE GREATER OTHER THAN THE AMOUNT ACTUALLY PAID BY YOU TO AKSA HOME OR AN AUTHORIZED RESELLER OF AKSA HOME FOR THE APPLICABLE PRODUCT IN THE PREVIOUS SIX (6) MONTHS (IF APPLICABLE). THIS LIMITATION IS CUMULATIVE AND WILL NOT BE INCREASED BY THE EXISTENCE OF MORE THAN ONE INCIDENT OR CLAIM. EASYWALKER DISCLAIMS ALL LIABILITY OF AKSA HOME'S LICENSORS AND SUPPLIERS.

8. DISPUTES Disputes relating in any way to your use of the products or these Terms and Conditions shall be subject to confidential arbitration in Amsterdam, the Netherlands. Only if you have violated or threatened to violate our intellectual property rights in any way, can we seek judicial or other appropriate relief from a court of competent jurisdiction. You hereby consent to the venue and jurisdiction of the courts of Amsterdam and waive all defenses of lack of personal jurisdiction and forum non conveniens relating thereto. The arbitrator's award shall be final and binding and may be entered into judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, arbitration under these Terms and Conditions shall not be merged with arbitration in which any other party is subject to these Terms and Conditions. You agree that, regardless of any law or regulation to the contrary, any claim or cause of action arising out of , relating to or in connection with the sale or use of products from AKSA Home or these Terms and Conditions, must be filed within one (1) year after such claim or cause of action arises, or shall be forever barred. No right or remedy of ours is separate from the others, in law or in equity, including but not limited to damages, attorneys' fees and costs. No waiver by us of our rights or remedies under these Terms and Conditions shall imply any obligation to grant similar, future or other waivers.

9. CHOICE OF LAW All matters relating to these Terms and Conditions and any dispute or claim arising out of or relating to the Products or these Terms and Conditions shall be governed by and construed in accordance with the laws of the Netherlands.

FORCE MAJEURE You agree that AKSA Home is not responsible for anything that we would otherwise be responsible for, if it is the result of events beyond our control, including but not limited to acts of God, war, insurrection , civil disturbances, terrorism, crime, labor shortages (including lawful and illegal strikes), embargoes, mail disruptions, communication disruptions, failure or lack of infrastructure, lack of materials or other events beyond our control.

SEVERABILITY In the event that any provision of these Terms and Conditions is held to be unlawful, inconsistent with any other provision of the Terms and Conditions, or otherwise unenforceable, the Terms and Conditions shall remain in effect as if they had been stated without including such unenforceable provision. If two or more provisions of these General Terms and Conditions are considered to be in conflict with each other, AKSA Home shall have the sole right to choose which provision shall remain in force.

12. NO WAIVER We reserve all rights granted to us under these Terms and Conditions and under the provisions of applicable law.
